Terms and Conditions

1) General

These General Conditions relate to the purchase of products and services on the e-commerce website www.gianniconti.com, belonging to the company Elda Trade Ltd, registered in the Macerata Business Register N° MC109958, VAT number 01006570434 with headquarters in Via Maestri del Lavoro, 8 – 62010 Mogliano (MC) Italy. Each purchase transaction shall comply with the provisions of Legislative Decree nr. 185/99 and, with regard to the protection of confidentiality, will conform to the regulations defined in Law nr. 675/96 and its subsequent modifications.

2) Acceptance of general terms and conditions of sale

By sending confirmation of their purchase order electronically, the Customer unconditionally accepts these General Conditions of Sale and undertakes to observe them in all dealings with the Company, declaring to have read and accepted all the indications provided pursuant to the aforementioned rules, and also acknowledging that the Company itself does not consider itself bound to different conditions unless previously agreed in writing.

The Company offers for sale the products it has made via the website www.gianniconti.com and carries out e-commerce activity exclusively aimed at retail.

3) Users and Orders

These General Conditions of Sale must be thoroughly read on-line by the users of the www.gianniconti.com website before they confirm their purchases. The placing of an order implies complete awareness of all general sales conditions and the acceptance thereof.

The customer agrees and undertakes, upon completion of the online purchase procedure, to print and keep these general conditions of sale, previously studied and accepted during the purchase procedure, in order to fully satisfy the provisions of articles 3 and 4 of Legislative Decree no. 185/1999.

Only final consumers can use the e-commerce site www.gianniconti.com, i.e. natural persons over the age of 18 who act for purposes not related to any commercial, entrepreneurial, craft and / or professional activity that may be carried out, and who fall within the definition of “consumers ” as per Legislative Decree 206/2005 and subsequent amendments (the “Consumer Code”).
It is also understood that Elda Trade Ltd may ultimately decide not to process the order, and / or consider it ineffective, should it not be possible to verify the correctness of information relating to the shipping address and the billing data, or should the order be deemed to have been carried out for the purpose of resale, in which case the Company reserves the right to terminate the contract with immediate effect and with simple written communication sent via email.

4) Prices

The purchase prices of Elda Trade Ltd products will be specific to each country from which an order originates and will be inclusive (gross) of any taxes. The essential characteristics of the products and theri prices are indicated in the product specifications on the site which the user must access before executing the order. The images of the products may not fully correspond to the real ones. Before completing the purchase, the Client will be presented with a summary of the unit cost for each product chosen, as well as the total cost in the case of several products being purchased.

5) Shipping

The costs of transporting the product will be borne by the user of the e-commerce service and will be explicitly indicated when purchasing the product. Elda Trade Ltd undertakes, as entrusted by the user, to enter into a shipping contract with a primary company taking into account the conditions applied by the carrier itself.

The user:

– may request that the purchase is sent to a different address than that of the order and / or billing address (but always within the same country).

– must indicate a shipping address at which someone is always present to collect the package. In the event that someone is not present at the address indicated for the collection, an address other than that of residence must be indicated which meets the required conditions.

– Elda Trade Ltd will normally process the order within 48 working hours following receipt of payment confirmation, except during particular periods or under conditions that entail different shipping times, which will however be made clear on the site. Estimated delivery times depend on the carrier chosen (in Italy and in general throughout Europe estimated delivery times are 3-5 working days).
Furthermore, once the shipment has been made, Elda Trade Ltd will automatically send an e-mail containing all the information the user needs to track the order, including a direct link to the DHL or GHS portal (or that or any other carrier chosen) for immediate verification of delivery status. Elda Trade Ltd is not in any way responsible for the failure and / or delayed delivery of the goods ordered, if the collection conditions described above are not respected, or if any of the information supplied by the customer is incorrect.

– if the items ordered are not delivered within a period of 15 working days from the order confirmation, the user can contact Elda Trade Ltd customer service directly. The status of the order and / or the status of the shipment will be checked with the shipping company. The products will in any case be delivered as quickly as possible and complying with the terms of the law (i.e. pursuant to article 61 of the Consumer Code, 30 days from the Delivery Date).

The purchased products will be delivered to the address indicated by the customer. Each shipment contains the ordered goods, a summary of the order and the documents necessary for any returns. Deliveries are carried out on all working days. The delivery of the products may be split, without this entailing any liability for Elda Trade Ltd.

Before accepting delivery of the product, the customer is required to check that the package is intact, and not damaged or wet. The Company is not liable for damages or thefts made in the period following the delivery of the package to the courier.

6) Shipping Times & Costs

Shipping can only take place to the same country in which the order was made, or in one of the countries indicated in this table.

The order will be processed within 24-48 working hours following its receipt by Elda Trade Ltd. Eltra Trade Ltd undertakes to ensure that you receive your order within 4-5 working days from order and payment confirmation (estimated times in most European countries). Please remember that delivery times may be longer in the case of public holidays. Carriers do not deliver on 25/12, 26/12, 01/01 and on weekends.

7) Returns

Packaging for the returned goods is the responsibility of the buyer and must make use of the original box in order to any deterioration of the goods prior to arrival at their destination. Only in the case in which the original packaging is unusable can a box equivalent in size and strength be used. Return shipments made in any way other than that stipulated above will not be accepted.

Return packaging and shipping charges are the responsibility of the customer; in addition, from 1 July 2021, based on the new European directive 24/55/17, VAT will be applied to all shipments from non-EU Countries, regardless of their value. Therefore, customs duties, equal to 22% of the purchase value + administrative costs related to customs clearance, will also be charged to the customer.

Returns must be made in a single shipment by filling in the appropriate form which can be downloaded from the reserved area and by sending form and goods to:

After the Company has received the return and verified that it has been carried out satisfactorily, it will send an e-mail to the address provided by the Customer as confirmation of acceptance. If the order was paid for by credit card, the refund currency depends on the provider. If the order was paid for via Paypal, the refund is made directly to the Paypal account used for the payment.

Return packaging and shipping charges are the responsibility of the customer.

Purchases with delivery to non-EU countries may be subject to customs duties. The costs are charged to the customer.

8) Packaging

Each bag purchased will be delivered in a box and supplied with a dustproof fabric bag; small leather goods are delivered in a box but will not have a dustproof bag.

9) Order compilation

To conclude the purchase contract, the user must complete every stage of the order process on the site and confirm payment for the order on the site of the selected payment institution. It is understood that orders from countries other than those indicated and that differ in any way from the conditions laid out above (for quantity and place of shipment) will in no case be accepted.

Upon confirming the purchase and once the transaction is complete, the customer will receive an e-mail containing the order number, the date and the total amount of the Order. The contract is finalised with the receipt, by Elda Trade Ltd, of the order form, the details of which are subject to verification. During the ordering process, summary information is provided on the characteristics of the product, price, shipping costs, and product delivery and payment methods. The order form will be stored in our database for the period of time required to process your order and pursuant to relevant norms and regulations.

The Customer can access his order form at any time by consulting the RESERVED AREA section on the website.

To complete the purchase contract, the order procedure and payment on the associated site must be completed. Both operations must be carried out following the instructions on the site. In the event that, due to a typing error or similar, orders have been compiled that the user does not wish to execute owing to characteristics, quantities and / or prices, the user must not complete the procedure. The user is responsible for the correctness of the information provided during the order and payment procedure. Elda Trade Ltd assumes no responsibility for “unwanted” orders, sent by mistake and / or by minors, and will execute them in accordance with the information provided by the user and will be able to demand the corresponding payment.

If during the process of completing the order and concluding the contract, the user finds that the price of one or more of the products they intend to select for the subsequent purchase is clearly lower than that normally applied – net of any discounts and / or promotions in force at that time – due to an obvious technical problem on the site, they are requested not to complete their purchase order and to report the aforementioned technical error to Elda Trade Ltd, by sending an e-mail to info@gianniconti.com.

If the Consumer has completed a purchase order which includes a Product whose price is clearly lower than the standard applicable price, net of any discounts and/or promotions in force at that time, due to a technical problem that has occurred on the Site:

(a) if the user has not yet received the product, Elda Trade Ltd will (i) cancel the order, the delivery of which will therefore not be carried out, simultaneously sending notice to this effect by e-mail, to the e-mail address indicated by the user during the compilation and transmission of the order and (ii) reimburse the user for payments made by the same in relation to the cancelled order, including delivery costs, without undue delay and, in any case, no later than 14 days from the cancellation of the order, using the same means of payment as used by the user for the initial transaction;

(b) if the user has already received the product, Elda Trade Ltd will promptly inform the user via e-mail of the error which occurred in the process of completing the order, offering them the choice between (i) within and no later than the following 5 (five) days, paying Elda Trade Ltd via one of the available payment methods the amount corresponding to the difference between the correct price of the product and the incorrect price resulting from the purchase order, or (ii) cancelling their order, following the instructions contained in the same correspondence to return the product to Elda Trade Ltd, at the latter’s expense, to arrive no later than 14 (fourteen) days after the date of the e-mail, sending it to Elda Trade Ltd, without damage, accompanied by all its elements and accessories (including unaltered labels and tags attached to the product), and any instructions / notes / manuals, in the original packaging, with the guarantee certificate and accompanied by the return form, duly completed, which they will find attached to the e-mail sent by Elda Trade Ltd.

In the event that the user has chosen the option (b) (ii) above, Elda Trade Ltd will refund to the user any payments they had made in relation to the cancelled order, including delivery costs, without undue delay and, in any case, no later than 14 days from the cancellation of the order, using the same means of payment employed by the user for the initial transaction.

10) Product unavailability

Elda Trade Ltd will take every possible care to present on its e-commerce site only those products that are actually available in its warehouse, but should the products presented on www.gianniconti.com no longer be available when the order form is sent, Elda Trade Ltd undertakes to communicate the possible unavailability of the products ordered to the Customer within seven (7) days from the day following that of the transmission of the order. In the eventuality that payment accompanies the order form submitted, Elda Trade Ltd will refund the amount already paid by the Customer.

11) Legal guarantee

Elda Trade Ltd guarantees the conformity of the products with respect to the relative product specifications listed on the website for a period of two years and in accordance with articles 128 – 135 of the Consumer Code. The products purchased on the website www.gianniconti.it are subject, where applicable, to the terms of the Italian Legislative Decree 2.2.2002 No. 24 (G.U. No 57, 8.3.2002) regulating sale contracts and guarantees regarding consumer goods, or otherwise to the relative conditions of the Italian Civil Code. The guarantee is personal and will therefore only apply to the original purchaser. It is reserved for direct customers and not for retailers, resellers, etc.

The company Elda Trade Ltd reserves the right to verify the defect reported by the customer and to offer a replacement only after having carried out this check. The request will be processed only if the package is returned intact and in its entirety. The costs of returning the goods to the sender, however, remain the responsibility of the customer.

12) Payments

Payment for the purchased products and related shipping costs must be made by the customer when placing the order by using one of the credit cards listed online, or in advance by cash on delivery with an additional charge of € 5,00 (cash on delivery is valid only for Italy).

Through PayPal, world leader in secure online payments, we accept all the main credit cards along with payments with a PayPal account. We recommend a PayPal account or credit card as the easiest and most convenient method of payment to reduce order processing times.
With Stripe you can make the payment easily and securely. The Stripe platform simplifies and helps to make all phases of the purchasing process safer.

The data relating to the order are encrypted and transmitted according to the SSL system (SecurSocket Layer) directly on PayPal’s servers that guarantee the security of data transmission according to current regulations. Thawte is one of the leading certification bodies for SSL (SecureSocket Layer) Certificates used to protect online transactions. We accept exclusively credit cards belonging to the Visa and Mastercard networks for payment on our site.

Your credit card details are protected and secure as they will be provided in encrypted from directly to the secure Paypal servers. (https://www.paypal.com) The data are then conveyed by the Bank to the international authorisation circuits which return the outcome of the transaction, providing information on the successful completion of the purchase. Security is strengthened via the use of the most popular security system for data encryption – the SSL3 (SecureSocket Layer) with 128-bit Triple Des algorithm – a widely recognised security standard issued by Verisign (http://www.verisign.com).

The amount will be charged to the credit card when the customer gives confirmation of the order.

13) Withdrawal

Purchases made on gianniconti.com are governed by the Italian law on postal sales. Should the customer wish to renounce the purchase made, they can exercise their right of withdrawal within 14 days from the delivery date and return the product without suffering any penalty and without giving any reason. The Company undertakes to accept the return of any item, provided it is in perfect condition, refunding the full amount.

The costs incurred for the initial shipment of the goods, from the Company to the consumer, must also be refunded if the consumer chose the cheapest shipping method among those offered by the site. If, on the other hand, the consumer had chosen a type of delivery implying higher costs than the cheapest option offered by the Company, the shipping costs will be at the consumer’s expense.

To exercise the right of withdrawal, the customer must inform the Company of their decision within 14 days, by filling in the appropriate form – received during the purchase or downloadable from the site – and sending it by e-mail to: resi@gianniconti.com or through any other communication suitable for expressing the decision explicitly.

To exercise their right of withdrawal, the customer must send the purchased items intact and in their entirety. Elda Trade Ltd must receive them within 30 working days from delivery to the customer.

The products must not have been used, worn, washed or damaged; they must also be intact in all their parts including any labels.

14) Disputes

Any sales contract finalised between Elda Trade Ltd and the buyer pursuant to these General Conditions will be governed and interpreted in accordance with Italian laws, in particular the Consumer Code. In any case, the rights that may be attributable to the Customer shall be protected by legally binding provisions in current State law. For any dispute concerning the validity, interpretation or execution of this same contract, the Court of Macerata will have exclusive jurisdiction.
